This privacy and cookie policy ("Privacy Policy") describes how PEPSIA SAS, registered in the Montpellier Trade and Companies Register under number 823 303 839 and whose registered office is at 145 Rue Jeremy Bentham, 34470 Perols (hereinafter "Pepsia"), uses your personal data and manages the cookies it publishes. It applies when Pepsia processes personal data concerning you and deposits cookies on your equipment, issued by it or by its partners when you browse its website or when viewing the video content it provides and distributed on its partners' websites (hereinafter the "Services").

 

1. How do we collect your personal data?

The personal data concerning you and processed by Pepsia is collected indirectly and automatically via your browsing traces on the Sites. 

The information collected automatically includes:

  • Information about your use of the Sites such as pages viewed, connection time and duration, IP address, and connection mode, such as the type and version of your web browser;
  • Information about your equipment such as your operating system.

We may use and disclose this data for the purposes identified in the article "Why do we use your data (purposes)?" of this Privacy Policy, within the limits of the applicable regulations.

We inform you that we may also use the automatically collected data in aggregate form for various purposes provided that the data does not allow us to identify you personally: this aggregate data will not be considered as personal data.

1.1. Cookies and web beacons

As part of the improvement of the services offered on the Sites, cookies are installed during your browsing.

A "cookie" is a small file, which does not allow the identification of the user, but which records information about the browsing of a computer on a site.

Some of our cookies have the exclusive purpose of enabling or facilitating electronic communication and are strictly necessary for the provision of our online communication services at the express request of the user.

These are mainly session cookies - which are temporary and deleted when you close your browser - allowing authentication and connection to the Site as well as memorization of navigation elements during a session and in particular to check whether or not your browser accepts cookies.

The cookies we use record information about your preferences and your use of the Services.

The period of validity of your consent to the use of these cookies will not exceed thirteen (13) months.

1.2.3. Statistics and audience measurement

In order to adapt the Sites, their content and services to your expectations, we use the "Google Analytics" audience measurement service. The cookies used as part of this service allow us to analyse your online behaviour, including the number of visits, the number of pages viewed, as well as activity on the Sites and the frequency of return.

We inform you that the data generated by the cookies concerning the use of the Sites (including the IP address in short and unreadable form that does not allow the user to be identified) will be transmitted and stored by Google on servers that may be located in the United States.

Google will use this information for the purpose of evaluating the use of the Sites, compiling reports on the activity of the Site and providing other services relating to the activity of the Sites and the use of the Internet.

Google may also transfer this information to third parties where required to do so by law or where such third parties process the information on Google's behalf. Google will not associate the IP address of Internet users with any other data held by Google.

1.3 Cookies issued by third parties

Cookies are considered as third party or proprietary depending on whether or not they are associated with the domain of a site.

When you access the Sites, one or more cookies of third-party companies may be placed on your computer.

The purpose of these third-party cookies is to identify your centers of interest through the products consulted or purchased on the Sites and to collect browsing data in order to personalize the advertising offer addressed to you, including outside the Sites.

These cookies make it possible for third parties to study your preferences to be able to offer you targeted advertisements.

    • When we use Hubspot's scripts, the following are installed:
  • - A visitor tracking cookie (time stamping - expiration: 2 years);
  • - A cookie to determine whether the session number and timestamps should be updated in the cookie; 
  • - A cookie containing the domain, number of views and time stamp of the beginning of the session (Expiration: 30 minutes)

The legal basis of the data processing operations that we carry out is your consent.

3.    The recipients of your data

Your personal data is exclusively intended for Pepsia, with the exception of that collected by third parties via their cookies and over which we have no control.

Within the limits of their respective powers, the following may have access to your personal data:

  • - the persons in charge of the marketing, sales and prospecting departments;
  • - our partners that you have previously authorized;
  • - the competent authorities who may request it under the applicable legislation.

4.    Retention period

Pepsia is particularly committed to the respect of your privacy and compliance with personal data protection regulations.

To this end, we inform you when we collect information about you, it is not kept in a format which allows you to be identified for a period which does not exceed 24 hours.

Indeed, after this period, only data concerning the content viewed is kept and your data is aggregated in the form of anonymous statistics.

6.    Your rights

In accordance with Law no. 78-17 on information technology and civil liberties and General Data Protection Regulation 2016/679 (hereinafter together referred to as the "Regulations"), you have a right of access, rectification and - for legitimate reasons - to oppose the processing of your personal data.

You also a right to the limitation and portability of your personal data under the conditions laid down by the Regulations.

We remind you that, in accordance with the Regulations, your right to portability only applies to data that you have provided to us directly on the basis of your consent or the execution of a contract concluded with Pepsia. In addition, it only applies if your data is processed by computer (paper files are therefore not concerned").

Finally, you also have the right to define instructions relating to the fate of your data after your death and to lodge a complaint with the French Data Protection Agency CNIL (www.cnil.fr) see for more information on your rights.

In accordance with the Regulations, to exercise your rights, you must provide proof of your identity.

If you consider, after contacting us, that your rights have not been respected, you can lodge a complaint with the CNIL.

7.    Security of your personal data

We use a variety of data security measures to guarantee the confidentiality and integrity of your personal information.

To this end, we inform you that:

  • - All Pepsia employees are committed to ensuring the protection and security of your personal data and are subject to a confidentiality agreement;
  • - Our Site is secure, in particular through the use of a TLS protocol;
  • - We regularly back up data to prevent any risk of loss or damage;
  • - All interventions on our IT environment are secure;
  • - We have installed means of protection for our premises and servers;
  • - We have implemented a data access authorization policy so that only authorized persons can access your personal data;
  • - We impose confidentiality and security commitments on all our service providers.

However, we are unable to exercise any control over the Sites of our partners, who ensure their security alone, and under their entire responsibility.

8.    The transfer of your personal data outside the European Union

Your personal data may be transferred to our subcontracts in a country located outside the EU.

Concerned about the security and confidentiality of your data, we inform you that our service providers are subject to an obligation of confidentiality and that all transfers are made to:

  • - Either a country recognized by the European Commission as ensuring an adequate level of protection;
  • - Or a US company complying with the principles of the Privacy Shield;
